Lagaidim.com ("Lagaidim", "we", "our", "us", "Store", or "Website") is a legally registered e-commerce business operating from Dallu-15, Kathmandu, Nepal.
This Return and Refund Policy explains the circumstances under which products purchased from Lagaidim.com may be returned, exchanged, or refunded.
This Policy applies to perfumes, perfume decants, clothing, apparel, fashion accessories, wearable products, jewelry, lifestyle products, and other products sold by Lagaidim.com.
This Policy should be read together with our Terms and Conditions, Privacy Policy, Shipping and Delivery Policy, Payment Policy, and other applicable policies published on Lagaidim.com.
This Policy is intended to comply with applicable laws of Nepal, including the Consumer Protection Act, 2075, the Electronic Commerce (E-Commerce) Act, 2081, and other applicable laws and regulations.
Nothing in this Policy is intended to remove, restrict, or waive any mandatory consumer right or legal remedy available under applicable law.
1. Statutory Consumer Return Rights
Lagaidim respects the return and refund rights provided to consumers under applicable laws of Nepal.
Under the Consumer Protection Act, 2075, a consumer may generally return purchased goods within the statutory period where the legal conditions for return are satisfied. The Act provides a seven-day return period for goods in cases of dissatisfaction, subject to its conditions, and provides a fifteen-day period for sealed goods where the seal remains unbroken. The consumer may request return, an equivalent replacement, or the amount paid, as applicable under the law.
The Electronic Commerce (E-Commerce) Act, 2081 further provides that where goods or services purchased through e-commerce do not conform to the description provided by the business, the buyer may return the goods or services without using or damaging them, and the business must accept the return in accordance with the Act. Where the buyer does not accept an equivalent replacement, the amount paid, including applicable taxes, is to be refunded as provided by the Act.
Where there is a conflict between this Policy and a mandatory requirement of applicable law, the applicable law shall prevail.
2. General Return Conditions
Except where applicable law provides otherwise, products accepted for return must:
- Be unused.
- Be in the same condition in which they were received.
- Remain in their original packaging where applicable.
- Have all original tags, labels, seals, accessories, manuals, boxes, and other included items where applicable.
- Not have been washed, altered, modified, repaired, damaged, stained, scratched, or otherwise changed by the customer.
- Not show signs of use, wear, testing, or consumption.
- Be accompanied by the original invoice, bill, receipt, or valid proof of purchase.
Lagaidim may inspect returned products before approving a return, exchange, or refund, subject to applicable law.
3. Product Must Not Be Opened or Used
For products where opening or use affects the product's condition, hygiene, safety, resaleability, or sealed status, the product should remain unopened and unused where required by applicable law.
This is particularly relevant to:
- Perfumes
- Cosmetics and fragrance products
- Sealed personal-use products
- Certain wearable products
- Products supplied with manufacturer seals
- Products with tamper-evident packaging
Where a sealed product is returned under the statutory sealed-goods provisions, the seal must remain unbroken as required by law.
Opening, spraying, applying, testing, using, washing, altering, or otherwise changing a product may affect eligibility for return where applicable law permits such exclusion.
4. Perfume and Fragrance Returns
Due to the nature of perfumes and fragrance products, customers should carefully confirm the following before placing an order:
- Brand
- Fragrance name
- Concentration
- Bottle size
- Decant size
- Quantity
- Variant
Once a perfume has been opened, sprayed, tested, used, or otherwise altered, it may not be eligible for return where applicable law permits exclusion of used or opened goods.
For sealed perfume products, the statutory provisions applicable to sealed goods will apply.
A customer should not open or use a perfume if they intend to request a return.
5. Perfume Decants
Because decants are individually prepared and transferred into separate containers, returns of decants are subject to applicable law and the specific condition of the product.
A decant that has been opened, sprayed, tested, used, contaminated, emptied, altered, or damaged by the customer may not be eligible for return where legally permissible.
Customers should confirm the fragrance, decant volume, and other relevant details before ordering.
Nothing in this section limits any statutory return right that cannot legally be excluded.
6. Clothing, Apparel, and Wearable Products
For clothing, apparel, footwear, jewelry, watches, bags, sunglasses, and other wearable products, customers should carefully check:
- Size
- Measurements
- Color
- Product variant
- Model
- Material
- Design
- Quantity
before placing an order.
Customers should avoid removing tags, washing, altering, wearing, damaging, or otherwise changing a product if they intend to return it.
Where a statutory return right applies, the product must be returned in the condition required by applicable law.
Minor variations in color caused by screen settings, lighting, photography, or display technology do not necessarily constitute a product defect.
7. Customer Preference and Product Expectations
Customers are encouraged to carefully review the product description, photographs, size information, measurements, specifications, fragrance information, and other available information before placing an order.
A customer's personal preference, aesthetic expectation, fragrance preference, preferred fit, or perception of a product does not by itself establish that the product is defective or incorrectly supplied.
However, where applicable Nepalese consumer law grants a statutory right to return goods due to dissatisfaction, Lagaidim will honor that right subject to the conditions and exclusions established by law.
Accordingly, this Policy does not attempt to remove a statutory return right merely because the customer "does not like" the product.
8. Products That Do Not Match the Website Description
If a product supplied by Lagaidim does not conform to the product description provided by Lagaidim, the customer may have a statutory right to return the product under the Electronic Commerce (E-Commerce) Act, 2081.
Such goods should not be used, damaged, altered, or otherwise changed before being returned.
Where the statutory requirements are satisfied, Lagaidim will process the return in accordance with applicable law.
9. Wrong Product Supplied
If Lagaidim sends a product different from the product ordered, the customer should contact us as soon as reasonably possible.
The customer should provide:
- Order number
- Invoice or receipt
- Photographs of the product received
- Photographs of the packaging and shipping label
- Description of the discrepancy
- Video evidence where reasonably requested
Lagaidim will investigate the matter and provide an appropriate resolution in accordance with applicable law and this Policy.
10. Damaged Products
Customers should inspect the package and product as soon as reasonably possible after delivery.
If a product appears damaged, broken, leaking, crushed, tampered with, or otherwise materially compromised, the customer should contact Lagaidim promptly.
For damage-related claims, Lagaidim may require:
- Clear photographs of the package.
- Clear photographs of the product.
- Photographs of shipping labels.
- Photographs of seals and packaging.
- Unboxing videos where available.
- A video showing the condition of the product.
- Order number.
- Invoice or receipt.
- Description of the damage.
Lagaidim will examine the evidence and may coordinate with the relevant delivery partner where the damage appears to have occurred during transportation.
The final determination will be based on the available evidence, inspection where necessary, delivery records, applicable law, and the circumstances of the particular case.
11. Unboxing Evidence
For expensive, fragile, sealed, or sensitive products, customers are strongly encouraged to record a continuous unboxing video beginning before opening the outer package and continuing until the product has been fully inspected.
An unboxing video may assist Lagaidim in determining:
- Whether the package was damaged before opening.
- Whether the correct product was supplied.
- Whether the product was damaged during transportation.
- Whether the package was tampered with.
- Whether accessories or components were missing.
Failure to provide an unboxing video does not automatically eliminate a customer's statutory rights, but the absence of evidence may make investigation of certain claims more difficult.
12. Missing Items or Accessories
If an order is missing an item, accessory, component, or quantity that was included in the confirmed order, customers should contact Lagaidim promptly.
The customer may be asked to provide photographs, videos, packaging information, and other evidence necessary to investigate the issue.
Lagaidim will investigate the matter and provide an appropriate resolution in accordance with applicable law.
13. Return Request Procedure
Customers wishing to return a product should contact Lagaidim through an official communication channel.
The return request should include:
- Customer name
- Order number
- Invoice or receipt
- Product name
- Reason for return
- Photographs where applicable
- Video evidence where applicable
- Description of the issue
Customers should not send a product back without following Lagaidim's return instructions where prior authorization is required.
14. Return Authorization
Where a return request requires inspection or authorization, Lagaidim may review the request before providing return instructions.
Authorization to send a product back does not automatically mean that the return, exchange, or refund has been finally approved.
The returned product may be inspected after receipt.
15. Return Inspection
Upon receiving a returned product, Lagaidim may inspect:
- Product condition
- Packaging
- Seals
- Tags
- Serial or batch information where applicable
- Accessories
- Quantity
- Signs of use
- Signs of damage
- Signs of alteration
- Other relevant conditions
The final determination will be made in accordance with applicable law and the circumstances of the return.
16. Returns of Used, Altered, or Damaged Products
Where permitted by applicable law, a return may be rejected if the product has been:
- Used
- Washed
- Sprayed
- Applied
- Worn
- Altered
- Modified
- Repaired
- Damaged
- Scratched
- Stained
- Contaminated
- Misused
- Missing original components
- Returned without required packaging or seals
This restriction does not apply where applicable law provides a non-waivable right to return a defective or otherwise legally returnable product.
17. Sealed Products
For sealed products, customers should keep the seal intact if they intend to exercise a return right.
Under Nepal's Consumer Protection Act, sealed goods may generally be returned within fifteen days while the seal remains unbroken, subject to the applicable statutory requirements.
18. Products Excluded From Return Where Permitted by Law
Subject to statutory consumer rights, certain products may not be eligible for return where they have been opened, used, altered, or otherwise changed.
This may include:
- Opened perfumes
- Used decants
- Opened personal-use products
- Washed or worn clothing
- Altered clothing
- Personalized or customized products
- Products damaged after delivery due to customer handling
- Products missing original components
- Products with broken seals where the law permits exclusion
- Products that have been contaminated or otherwise rendered unsuitable for resale
Where applicable law provides a mandatory return right, that legal right will prevail.
19. Return Shipping Cost
Customers may generally be responsible for the cost of returning a product to Lagaidim where the return is initiated for reasons attributable to the customer and where applicable law permits the cost to be passed to the customer.
However, Lagaidim will not impose a return charge where applicable law prohibits such a charge.
For example, where a return is legally required because Lagaidim supplied the wrong product or because the product does not conform to its description, the applicable statutory requirements will prevail.
Nothing in this Policy authorizes Lagaidim to deduct a return charge where Nepalese law prohibits such deduction.
20. Delivery and Return-to-Sender Costs
If a customer fails to receive a confirmed order and the package is returned to Lagaidim, the applicable provisions of the Shipping and Delivery Policy shall apply.
Where a partial COD payment was collected, Lagaidim may deduct reasonable and documented costs actually incurred in connection with:
- Packaging
- Order preparation
- Initial delivery
- Delivery attempts
- Return-to-sender transportation
- Courier handling
- Non-refundable payment processing
- Other directly related costs
Any remaining refundable balance will be handled in accordance with the applicable refund provisions and applicable law.
If the reasonable and documented costs exceed the partial payment, Lagaidim may request payment of the outstanding difference to the extent legally permissible.
This provision does not apply to restrict a statutory refund or other mandatory consumer remedy.
21. Partial Payment Refund Following Failed COD Delivery
Where a partial payment was collected for a COD order and the customer fails to receive the package, causing the package to be returned to Lagaidim, the partial payment will not automatically be treated as fully refundable.
Lagaidim may deduct reasonable and documented costs actually incurred for packaging, order preparation, delivery, delivery attempts, return transportation, courier handling, payment processing, and other directly related expenses.
Any remaining amount may be refunded to the customer in accordance with this Policy and applicable law.
If the applicable reasonable and documented costs are greater than the partial payment, the customer may be required to pay the remaining difference, where legally permissible.
22. Refund Eligibility
Where a refund is required or approved, the refund amount will be determined according to:
- Applicable Nepalese law
- The reason for return
- Product condition
- Applicable statutory rights
- Amount actually paid
- Applicable taxes
- Any legally permitted deductions
- The applicable Lagaidim policy
Where a statutory refund is required, Lagaidim will process the refund in accordance with the applicable legal requirements.
23. Refund of Product Price
Where a customer is legally entitled to a refund and chooses a refund rather than an equivalent replacement where permitted, Lagaidim will refund the applicable amount paid for the returned goods in accordance with applicable law.
Where the Electronic Commerce (E-Commerce) Act, 2081 applies to a qualifying return and the buyer does not accept an equivalent replacement, the Act provides for refund of the amount paid, including applicable taxes.
24. Refund Method
Refunds may generally be processed through an appropriate payment method, which may include:
- Bank transfer
- Original payment method where technically available
- Digital wallet
- Other officially approved payment methods
Lagaidim may request information reasonably necessary to process a refund and verify the identity of the recipient.
Customers should never provide passwords, OTPs, PINs, or other authentication credentials for the purpose of receiving a refund.
25. Refund Processing Time
Once a return has been received, inspected, and approved, Lagaidim will initiate the applicable refund within a reasonable period and in accordance with applicable law.
The actual time for funds to appear in the customer's account may depend on the bank, wallet, payment gateway, or other financial institution used to process the refund.
26. Cash on Delivery Orders
For COD orders, no payment may have been collected before delivery unless Lagaidim requested a partial payment.
Where a COD order qualifies for a refund after the customer has paid the full amount, Lagaidim may process the refund through an appropriate bank, wallet, or other official payment method.
Customers may be required to provide accurate account information for the refund.
27. Exchanges
Where permitted by applicable law and depending on stock availability, Lagaidim may offer an equivalent replacement or exchange instead of a monetary refund.
For returns arising under the Electronic Commerce (E-Commerce) Act, 2081, the buyer may request an equivalent-value replacement, subject to the Act and applicable circumstances. If the buyer refuses the replacement, the applicable refund provisions shall apply.
28. Replacement Product
Where Lagaidim agrees to provide a replacement, the replacement may be subject to:
- Availability
- Product specifications
- Applicable legal requirements
- Verification of the returned product
- Other applicable conditions
If the replacement product has a different price, the applicable price difference may be handled by mutual agreement, subject to applicable law.
29. Color, Size, Fit, and Personal Preference
Customers should carefully review product information before purchasing clothing and wearable products.
Colors may appear different due to:
- Screen settings
- Device displays
- Lighting
- Photography
- Camera settings
- Manufacturer variations
Size and fit may vary between brands and product styles.
Customers are responsible for reviewing available measurements and size charts before ordering.
However, where Nepalese law provides a statutory return right for dissatisfaction, Lagaidim will not use personal preference, size, fit, or aesthetic dissatisfaction as a basis for unlawfully refusing that statutory right.
30. Fragrance Preference
Perfume performance and perception may vary from person to person.
Factors such as skin chemistry, environment, temperature, application method, personal sensitivity, and individual preference may affect how a fragrance smells or performs.
A customer's subjective opinion regarding fragrance smell, projection, longevity, sweetness, freshness, or suitability does not by itself establish that a perfume is defective or incorrectly supplied.
However, any statutory return right available under applicable law remains unaffected.
31. Product Description Discrepancies
Lagaidim strives to provide accurate product information but, as stated in our Terms and Conditions, some product information may be compiled from manufacturers, distributors, third-party sources, reference websites, and AI-assisted tools.
If a product materially fails to conform to the description provided by Lagaidim, the customer may have a statutory return right under the Electronic Commerce (E-Commerce) Act, 2081.
32. Manufacturer Packaging Changes
Manufacturers may change:
- Packaging
- Labels
- Bottle designs
- Tags
- Boxes
- Colors
- Ingredients
- Product presentation
without prior notice.
A minor packaging or design variation that is consistent with the manufacturer's current product may not constitute a defect or description mismatch.
33. Authenticity-Related Claims
Lagaidim is committed to selling authentic products.
If a customer has a genuine concern regarding the authenticity of a product, the customer should contact Lagaidim immediately and provide:
- Order number
- Product details
- Photographs
- Batch information where available
- Packaging information
- Evidence supporting the concern
Lagaidim may investigate the matter using supplier information, product records, manufacturer information, batch information, and other relevant evidence.
34. Return of Incorrect Quantity
If the customer receives fewer units or a different quantity than ordered, the customer should contact Lagaidim promptly.
Lagaidim may verify the order, invoice, packing records, and delivery information before determining the appropriate resolution.
35. Return of Promotional Items
Where a returned order included promotional items, free gifts, samples, vouchers, credits, or other complimentary products, Lagaidim may require such items to be returned where they formed part of the promotional terms.
The treatment of promotional items will depend on the applicable promotion and applicable law.
36. Unauthorized Returns
Customers should not send products to Lagaidim without first following the applicable return procedure where prior authorization is required.
An unauthorized shipment may result in delays in processing because Lagaidim may be unable to identify the customer, order, or reason for return.
This does not prevent a customer from exercising a statutory right to return goods in the manner provided by applicable law.
37. Evidence and Inspection
Lagaidim may request reasonable evidence to verify a return or refund claim.
Evidence may include:
- Invoice
- Receipt
- Order confirmation
- Photographs
- Videos
- Packaging photographs
- Shipping label
- Product photographs
- Product batch or serial information
- Delivery records
- Other relevant information
Lagaidim may inspect the returned product before finalizing a return or refund where permitted by applicable law.
38. Fraudulent or Abusive Return Claims
Lagaidim reserves the right to investigate suspected fraudulent or abusive return activity.
This may include:
- False damage claims
- Product substitution
- Returning a different product
- Intentional product damage
- Repeated misuse of return procedures
- Tampering with seals
- False delivery claims
- Other fraudulent conduct
Where fraud is reasonably suspected, Lagaidim may take appropriate action permitted by law.
Nothing in this section limits legitimate statutory consumer rights.
39. Refunds and Third-Party Payment Providers
Where a payment was processed through a third-party payment gateway, bank, wallet, or other payment provider, the timing of the refund may depend partly on that provider.
Lagaidim will provide reasonable assistance in processing an eligible refund.
Customers should also cooperate with reasonable verification requirements imposed by the relevant payment provider.
40. Refunds and Delivery Charges
The treatment of delivery charges will depend on the reason for the return and applicable law.
Where applicable law requires a refund of amounts paid or prohibits additional charges or deductions, Lagaidim will comply with the applicable legal requirement.
Where a customer voluntarily requests a return outside a mandatory statutory right and Lagaidim agrees to accommodate the request, applicable delivery or return costs may be handled according to the agreed return arrangement and applicable law.
41. Customer Responsibility for Return Packaging
Customers returning an eligible product are responsible for packaging the product appropriately to prevent damage during return transportation.
Where a product is damaged because it was improperly packaged by the customer during a return, that damage may affect the return claim where applicable law permits.
Customers should use suitable protective packaging, particularly for perfumes, glass bottles, fragile accessories, and other delicate products.
42. Return Through Delivery Partner
Where Lagaidim authorizes a return through a delivery or courier partner, the customer should follow the instructions provided by Lagaidim.
The applicable return shipping cost will depend on the reason for the return and applicable law.
Customers should retain any return tracking information until the return has been completed.
43. Customer-Borne Return Costs
Where applicable law permits the customer to bear the return cost, the customer shall generally be responsible for the return shipping cost.
This may apply to customer-requested returns or other returns where Lagaidim is not legally required to bear the return transportation cost.
However, Lagaidim will not charge or deduct a return cost where applicable law expressly prohibits such a charge.
44. Statutory Rights Prevail
This Policy does not replace or restrict the rights granted to consumers under Nepalese law.
In particular, Lagaidim will comply with mandatory return, replacement, refund, compensation, disclosure, invoice, and consumer-protection requirements applicable to the relevant transaction.
Where applicable law gives a customer a right that is more favorable than this Policy, the applicable legal right shall prevail.
45. Policy Changes
Lagaidim may update, modify, or revise this Return and Refund Policy from time to time.
Changes become effective upon publication on Lagaidim.com unless otherwise stated.
Customers are encouraged to review the current version of this Policy before placing an order.
46. Contact for Returns and Refunds
For return, replacement, damage, or refund requests, customers should contact Lagaidim through the official communication channels published on Lagaidim.com.
Customers should provide the order number and relevant evidence when contacting us.
47. Customer Acknowledgement
By placing an order through Lagaidim.com, the customer acknowledges and agrees that:
- Products should be carefully checked before opening or using them.
- Customers should retain the original invoice, receipt, packaging, tags, seals, and accessories where applicable.
- Products should remain unused and in their original condition where required for the applicable return.
- Sealed products should remain sealed where the customer intends to exercise a statutory sealed-product return right.
- Customers should provide photographs and videos where requested for damage or discrepancy investigations.
- Customers are encouraged to record an unboxing video, particularly for expensive, fragile, or sealed products.
- A customer's subjective preference regarding fragrance, color, appearance, size, fit, or style does not establish that a product is defective or incorrectly described, although statutory dissatisfaction-based return rights under applicable Nepalese law remain applicable.
- Opened, used, altered, damaged, washed, worn, sprayed, applied, or otherwise changed products may be excluded from return where applicable law permits.
- Return shipping costs may be borne by the customer where the law permits such costs to be charged to the customer.
- Lagaidim will not impose a return charge where applicable law prohibits such a charge.
- If a COD order is returned because the customer failed to receive it, any partial payment may be reduced by reasonable and documented packaging, delivery, return, handling, and other directly related costs, subject to applicable law.
- If those reasonable and documented costs exceed the partial payment, the customer may be required to pay the outstanding amount where legally permissible.
- Refunds will be processed according to applicable law, this Policy, and the circumstances of the return.
- Nothing in this Policy is intended to waive or restrict any mandatory consumer rights available under the laws of Nepal.
Lagaidim.com reserves the right to inspect returned products and verify return claims while respecting all mandatory rights and remedies available to consumers under applicable law.
